Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CardRender platform, including digital business cards, email signatures, analytics, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who we are

CardRender, Inc. ("CardRender," "we," "us," or "our") provides a SaaS platform for creating, managing, and sharing digital business cards and email signatures for individuals and teams.

2. Eligibility and accounts

  • You must be at least 18 and able to form a contract to use the Service.
  • For organizational use, you represent you are authorized to bind your company to these Terms.
  • Keep your credentials confidential and notify us of any unauthorized use.

3. Subscriptions and billing

  • Some features require a paid subscription. Fees, terms, and limits are described at checkout or in your order.
  • Subscriptions auto-renew unless cancelled before the renewal date. You can cancel in your workspace settings; cancellations take effect at the end of the current term.
  • Payments are non-refundable except where required by law.

4. Permitted use

  • Use the Service only for lawful business purposes and in compliance with these Terms.
  • Do not misuse the Service, including: reverse engineering, attempting unauthorized access, interfering with security, sending spam, or uploading malware.
  • Do not use the Service to share illegal, infringing, defamatory, or deceptive content.

5. Customer content

  • You retain ownership of content you upload (e.g., card details, brand assets, directories).
  • You grant CardRender a limited license to host, display, process, and transmit your content as needed to operate the Service.
  • You are responsible for the accuracy of your content and for obtaining necessary rights to use it.

6. Privacy and data protection

  • Our Privacy Policy explains how we collect, use, and protect personal data.
  • We act as a data processor for customer content; you are the data controller for your end users and contacts.
  • We implement appropriate technical and organizational measures to protect personal data.

7. Availability and support

  • We aim for high availability but do not guarantee uninterrupted Service.
  • Planned maintenance and updates may occur; we strive to minimize disruption.
  • Support channels and response times may vary by plan.

8. Third-party services

Integrations (e.g., CRM, HRIS, identity providers) are provided by third parties. Your use of those services is governed by their terms and privacy policies.

9. Compliance

  • You will comply with applicable laws, including anti-spam, privacy, and data protection regulations when sending or sharing cards.
  • You will honor opt-outs and only message contacts with appropriate consent.

10. Confidentiality

Each party will protect the other party's confidential information with reasonable care and use it only for purposes of the Service.

11. Security

We use industry-standard security controls and encryption in transit. You are responsible for securing your devices, networks, and user access.

12. Warranties and disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

13. Limitation of liability

  • To the fullest extent permitted by law, CardRender will not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Our aggregate liability arising out of or related to the Service will not exceed the amounts you paid to CardRender in the 12 months before the claim.

14. Indemnity

You will indemnify and hold harmless CardRender from claims arising from your content, your misuse of the Service, or your violation of these Terms or applicable law.

15. Suspension and termination

  • We may suspend or terminate access for violation of these Terms, risk to the platform, or unlawful activity.
  • Upon termination, your right to use the Service ends. Sections that by nature should survive (e.g., limitations, indemnity, confidentiality) will survive.

16. Changes

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in-app or email). Continued use after changes take effect constitutes acceptance.

17. Governing law; disputes

These Terms are governed by the laws of Spain. Any dispute arising out of or related to the Service will be resolved exclusively in the courts of Madrid, Spain, and the parties consent to that jurisdiction and venue.
